Welcome to Holy Grail Vaults. These Terms of Service ("Terms") govern your access to and use of the Holy Grail Vaults website, hosted on the Shopify platform. By registering for an account, browsing, or placing a bid on our site, you agree to be bound by these Terms.

1. User Accounts and Eligibility

  • Age Requirement: You must be at least 18 years of age to create an account and participate in our auctions.

  • Account Accuracy: You agree to provide current, complete, and accurate information during registration and to keep this information updated.

  • Account Security: You are responsible for maintaining the confidentiality of your account credentials. Holy Grail Vaults accepts no liability for any unauthorized use of your account.

2. Bidding and Commitment to Purchase

  • Binding Contract: Placing a bid on Holy Grail Vaults constitutes a legally binding contract under English law. If you have the winning bid at the close of an auction (the fall of the virtual hammer), you are unconditionally committed to purchasing the lot.

  • Bid Retractions: Bids cannot be retracted or cancelled once placed, except in extraordinary circumstances determined solely at our discretion (e.g., an obvious typographical error).

  • Shill Bidding: Bidding on your own items, or colluding with family/friends to artificially inflate the price, is strictly prohibited, violates platform rules, and may constitute an offence under UK law. Such actions will result in immediate account termination.

  • Non-Paying Bidders: Failure to pay for a won lot within [Insert Number, e.g., 48] hours of the auction's close may result in account suspension, permanent banning, and potential debt recovery action to claim the owed amount.

3. Cancellations, Returns, and Refunds

  • Auction Exemption: Due to the nature of the auction process, all items are sold "as seen." We do not accept returns, exchanges, or offer refunds for "change of mind."

  • Not As Described (The Exception): In accordance with the Consumer Rights Act 2015, the only exception to our no-return policy is if the item you receive is substantially and materially different from the item described in the auction listing (e.g., receiving an entirely incorrect item, or the listing failing to disclose severe, item-destroying damage).

  • Claim Process: To claim a return under this exception, you must contact us at support@holygrailvaults.com within 30 days of receiving the item, providing clear photographic evidence of the discrepancy. Return shipping costs for verified claims will be covered by Holy Grail Vaults.

  • Statutory Rights: Nothing in these Terms shall affect your statutory rights as a consumer under UK law.

4. Item Descriptions and Condition

  • Condition: While we make every effort to describe all items accurately, all lots are sold with all faults and imperfections.

  • Due Diligence: High-resolution images form a material part of the description. It is the bidder's sole responsibility to examine all photos, read the description thoroughly, and ask any questions before placing a bid.

5. Payments, Fees, and VAT

  • Invoicing: Winning bidders will receive an invoice via email shortly after the auction concludes.

  • Payment Methods: We process payments securely via Shopify Payments. We accept Visa, Mastercard, Amex, PayPal.

  • Buyer's Premium: A Buyer's Premium of 10% will be added to the final hammer price of each lot.

  • VAT and Taxes: All bids and final hammer prices are inclusive of Value Added Tax (VAT) at the current UK rate, where applicable. Buyers are responsible for any customs duties or import taxes if shipping outside the UK.

6. Delivery and Collection

  • Shipping Costs: The buyer is responsible for all postage, packaging, and insurance costs, which will be calculated at checkout or added to the final invoice.

  • Risk of Loss: The risk of loss and title for items passes to you once the item has been delivered to you or your nominated safe place by our courier.

  • Unclaimed Items: Items paid for but not claimed or shipped within 30 days will be subject to storage fees or may be considered abandoned and relisted without a refund to the buyer.

7. Limitation of Liability

To the maximum extent permitted by law, Holy Grail Vaults and its affiliates shall not be liable for any indirect, incidental, special, or consequential loss arising out of or related to your use of the site, our auction services, or the purchase of any items. We do not exclude or limit in any way our liability to you where it would be unlawful to do so (including liability for death or personal injury caused by our negligence).

8. Platform Hosting

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is processed in accordance with our Privacy Policy and UK GDPR regulations.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in relation to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. (Note: Change to Scotland or Northern Ireland if your business is registered there).
